Military Child Pornography Defense Lawyers in Maryland

In 2012, changes were made to the UCMJ by executive order. These changes redefined the prosecutorial requirements for child pornography prosecutions in the military.

The accused may now be convicted of possessing, receiving, viewing, distributing or producing child pornography if he or she was aware that the images were of minors, or what appeared to be minors, engaged in sexually explicit conduct.

Second, the maximum allowable punishment for child pornography offenses has been increased. Where the punishment had been 10 to 20 years, plus dishonorable discharge and loss of pay and allowances, the punishments now range from 10 to 30 years, plus dishonorable discharge plus loss of pay and allowances.
